If you are considering working for Encore Preservation make sure to do your due diligence and demand your rights as an employee. Encore Preservation is an illegal unlicensed company operating in many states along the Midwest. Basically, they are a sub of a subs sub, the bottom of the barrel feeders. To initiate your rights as an employee start with IRS form SS-8 (download here) and inform the Internal Revenue Service of these tax evaders. To meet this requirement you need to prove them Encore Preservation runs your business. You should be able to answer whether or not you have control of your business performing mortgage field services.

Property Preservation is not Exempt from Work Comp or Licensing

Make sure this company meets its duty to maintain proper Workman’s Compensation insurance for you as an employee. This work comp policy will need to list the specific duties you perform as an employee – Roofing, Hazardous Materials Exposure, Concrete (Most cities require a bonded contractor Encore must be to be paid for the work) Electrical, Plumbing, Siding -(Requires an EPA Lead Renovator Licensing, as does re-glazing windows) Failure to comply with the lead based paint requirement stings. Report your employer for non compliance!

OSHA General Duty Clause

SEC. 5. Duties

(a) Each employer —

(1) shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees;

Your employer is required to pay the State minimum wage for work completed and make regular payroll tax payments to the IRS. Example Encore sends you a work order with a 48 hour turn time. The job is to drive 60 miles away round trip. The job pays $25 less 25% client less 40% Encore = $11.25 (Assume you drive your vehicle instead of theirs and gas cost $2.25) They just paid you $4.00 per hour to drive 2 hours round trip and you took the photos for free 

OSHA requires you are trained on the work that you are completing. This is done for your safety as an employee. If you think accidents don’t happen. Every year there is a workers memorial day. This day is set to remember people who went to worker expecting to go home to their families at the end of the day, and died at work. There are many reasons people die at work but the most important always seems to be that rules were not followed. This is not to say that people don’t follow rules but sometimes companies don’t follow them either and will remove a safety guard, or bypass a shut off to keep things moving. Of the most important things with training is the know how to do the job and a lot of states require those trainers are licensed or at least educated. Make sure that you receive the proper training from your employer and that your employer is licensed in their work. Doing so may save your life or someone else. The thing is guidelines while sometimes they suck are in place to keep people and future homeowners safe. You certainly wouldn’t want just anyone wiring up an outlet or messing with your electrical. What if you moved in a house full of mold that was covered with paint? Would that be safe for you and your kids? Who is responsible? Use your head when it comes to dealing with these illegal companies. Thankfully for you I have contacted the states in which they operate in as well as a company called Taylor and Sons and let them know about all the work they send you from MCS, NFR, Servicelink, Safeguard and all the other illegals. We know shit rolls downhill. If you doubt any claims made here check out the truth about these illegals and the lies they tell.

I was reading today that insurance companies won’t pay claims for contractors that are not licensed. These Secretary of States, and Contractor Registrations are going to be busy and to think Encore is only #2 on the list.
